President Barack Obama has invoked "state secrets" to prevent a court from reviewing the legality of the National Security Agency's warantless wiretapping program and moved late Friday to have a lawsuit challenging the program dismissed.

The move -- which holds that information surrounding the massive eavesdropping program should be kept from the public because of its sensitivity -- follows an earlier decision in March to block handover of documents relating to the Bush Administration's decision to spy on a charity. The arguments also mirror the Bush Administration's efforts to dismiss an earlier suit against AT&T.

The decision Friday involves a lawsuit filed by the civil liberties group Electronic Frontier Foundation, which is suing the NSA for the wiretapping program. The agency monitored the telephone calls and emails of thousands of people within the United States without a court's approval in an effort to thwart terrorist attacks.

In attempting to block a San Fransisco court from reviewing documents relating to the NSA program, the Obama Administration is also protecting other individuals named as defendants in the suit: Vice President Dick Cheney, former Cheney chief of staff David Addington and former Bush Attorney General Alberto Gonzales.

Luzerne County sits in the heart of Pennsylvania's struggling coal country; Wilkes-Barre is the county seat, a hardscrabble, blue-collar city that knew hard times even before this latest recession.

People there were shocked in January when federal prosecutors announced that respected county judges Mark Ciavarella and Michael Conahan had pleaded guilty to tax evasion and honest services fraud, the result of a lengthy investigation by the Internal Revenue Service and the FBI. Yesterday the Pa. State Supreme Court overturned hundreds of convictions of low-level offenders, ruling that all juveniles who had appeared in Ciavarella's courtroom without lawyers between 2003 and 2008 had not been adequately informed when they waived their right to counsel.

Ciavarella and Conahan, who face up to 7 years in prison, had devised a plot to use their positions as judges to pad their pockets. They shut down the old county-run juvenile detention center by first refusing to send kids there and, then, by cutting off funds, choking it out of existence. They then replaced the facility with a cash cow -- a privately owned lockup built by the judges' cronies -- and forged a deal for the county to pay $58 million for a 10-year period for its use. At the time Conahan was serving as president judge of the Luzerne County Common Pleas Court, a position that allowed him to control the county-court budget. Ciavarella was the Luzerne County juvenile court judge.

The judges entered plea agreements in federal court in Scranton in February admitting that they took more than $2.6 million in payoffs from the private youth detention center between 2003 and 2006.

The CIA has about 3,000 documents related to the 92 destroyed videotapes that showed “war on terror” detainees being subjected to harsh interrogations, the Justice Department has disclosed, suggesting an extensive back-and-forth between CIA field operatives and officials of the Bush administration.

The Justice Department said the documents include “cables, memoranda, notes and e-mails” related to the destroyed CIA videotapes. Those tapes included 12 that showed two “high-value” prisoners undergoing the drowning sensation caused by waterboarding and other brutal techniques that have been widely denounced as torture.

The number of documents – but not their contents – was mentioned Friday in a Justice Department letter from Lev Dassin, acting U.S. Attorney for the Southern District of New York, to U.S. District Court Judge Alvin Hellerstein in response to a Freedom of Information Act lawsuit by the American Civil Liberties Union.

Dassin told Judge Hellerstein that unredacted versions of the materials would be available for only him to review “in-camera” on March 26. Police in Denver arrested an ABC News producer today as he and a camera crew were attempting to take pictures on a public sidewalk of Democratic Senators and VIP donors leaving a private meeting at the Brown's Palace Hotel.

Four peace activists were arrested in Des Moines today as they tried to make a "citizens arrest" of Karl Rove, the long-time political advisor to President Bush. "It should be Karl Rove in that van. War Criminal!" one of the protesters shouted as the four were rounded up by cops. "Where's there justice in this country?"

Rove was in Des Moines to speak at a private fundraiser for the Republican Party of Iowa. The protestors let the police know of their wish to make a "citizens arrest" of Rove, then police arrested the four as they stepped beyond the gate at the entrance to the private Wakonda Club where Rove was speaking. Eighty-year-old Chet Guinn, a retired Methodist minister, was among those led away. "To be silent when major crimes are being committed against all humanity makes us accomplices," Gwinn told reporters just before his arrest.

The Buncombe County Sheriff’s Office arrested activists Mark and Deborah Kuhn in West Asheville Wednesday morning after a complaint that the couple was desecrating an American flag. They say a deputy invaded their home and used excessive force. [The photo at right, taken by a neighbor, shows Mark on the ground, with Deborah standing by, during the arrest.]

According to Deborah Kuhn, Scarborough “tried to force the door, but we got it closed and locked it with the deadbolt. He then kicked it, punched the glass out, unlocked our door and came after us.”
The sheriff’s office report states that “the man [Mark Kuhn] refused to identify himself and slammed the door on the officer’s hand, breaking the glass pane out of the door and cutting the officer’s hand.”

Asheville – Buncombe County Sheriff Van Duncan today said charges have been dropped against a couple accused of flag desecration and assaulting a deputy last week.

"After consulting with out legal counsel, and after talking with the District Attorney Ron Moore, we decided to ask for voluntary dismissal on all the criminal charges against the Kuhns," Duncan said. "They're being dropped because after reviewing the initial reason why were at the Kuhn's residence to begin with, it's pretty apparent to us where the Supreme Court stands on this issue (flag desecration) and also it has been dealt with in this state in 1971, and we do not feel like we can successfully prosecute the desecration of the flag statute."

Buncombe County sheriff’s deputy Brian Scarborough, acting on a complaint from a fellow National Guardsman, issued the charge Wednesday at the Brevard Road home of Mark and Deborah Kuhn.

BOSTON --A man who claims he failed the Massachusetts bar exam because he refused to answer a question about gay marriage has filed a federal lawsuit, saying the test violated his rights and that his religious beliefs were targeted.

Stephen Dunne, 30, of Boston, is seeking $9.75 million in the suit against the Massachusetts Board of Bar Examiners and the Massachusetts Supreme Judicial Court. He was denied a license to practice law in May after scoring 268.866 on the exam, just shy of the 270 passing grade.

Dunne, who is representing himself in the case, refused to answer an exam question addressing the rights of two married lesbians, their children and their property, and claims in the suit that it cost him a passing score.

In the suit, Dunne called the question "morally repugnant and patently offensive," and said he refused to answer it because he believed it legitimized same-sex marriage and same-sex parenting, which is contrary to his moral beliefs.

NEW PALTZ - A panel of educators and a journalist on Friday outlined claims that some elections over the past six years have been compromised by fraud and the improper invalidation of millions of ballots.

Speaking during an evening forum at SUNY New Paltz, University of Pennsylvania Professor Steven Freeman said research conducted in an effort to understand discrepancies between exit polls and reported vote counts during the 2004 presidential election led him to closely follow the 2006 campaign and conclude that Democrats should have picked up even more seats in the House and Senate.

Some election observers have questioned how President Bush was able to carry all-important Ohio in the 2004 election when most exit polls showed Democrat John Kerry winning the state.

"The first set of shocks is that elections can be stolen," Freeman told the roughly 250 people in attendance on Friday. "The remarkable thing is that there is almost no serious debate about this. ... It's a simple matter for a programmer (in states that have electronic voting), and this is something that you can do with a first-year programming course - put in two lines of code into the program."

Freeman said the electronic voting in 49 states is overseen by three companies, and he alleged that all have close ties to top Republicans.

'Presumably, staffers at the CPA's Information Management Unit, which produced the weekly reports, were cutting and pasting large sections of text into the reports and then eliminating all but the few short passages they needed. Much of the material they were cribbing seems to have come from the kind of sensitive, security-related documents that were never meant to be available to the public. In fact, about half of the 20 improperly redacted documents I downloaded, including the March 28 report, contain deleted portions that all seem to come from one single, 1,000-word security memo. DVD DRM row sparks user rebellion

Attempts to gag the blogosphere from publishing details of a DVD crack have led to a user revolt.

The row centred on a 'cease and desist' letter sent by the body that oversees the digital rights management technology on high-definition DVDs.

It requested that blogs and websites removed details of a software key that breaks the encryption on HD-DVDs.

The removal of the information from community news website Digg was a step too far for its fans.

As quickly as stories relating to the issue were removed, they were re-submitted in their thousands, in an act described by one user as a "21st century revolt".

The site collapsed under the weight of the attack at one point.

"He clearly appeared to be under the influence of something other than good sense," Chief Assistant District Attorney Nicki Patterson said.

Perks and stardom do not come to every amputee. Sgt. David Thomas, a gunner with the Tennessee National Guard, spent his first three months at Walter Reed with no decent clothes; medics in Samarra had cut off his uniform. Heavily drugged, missing one leg and suffering from traumatic brain injury, David, 42, was finally told by a physical therapist to go to the Red Cross office, where he was given a T-shirt and sweat pants. He was awarded a Purple Heart but had no underwear.

David tangled with Walter Reed's image machine when he wanted to attend a ceremony for a fellow amputee, a Mexican national who was being granted U.S. citizenship by President Bush. A case worker quizzed him about what he would wear. It was summer, so David said shorts. The case manager said the media would be there and shorts were not advisable because the amputees would be seated in the front row.

" 'Are you telling me that I can't go to the ceremony 'cause I'm an amputee?' " David recalled asking. "She said, 'No, I'm saying you need to wear pants.' "

David told the case worker, "I'm not ashamed of what I did, and y'all shouldn't be neither." When the guest list came out for the ceremony, his name was not on it.
